Minimum actions for evaluation and intervention of psychosocial risk factors

The Ministry of Labor issued Circular 0064 of 2020 establishing the minimum actions for the evaluation and intervention of psychosocial risk factors, promotion of mental health and the prevention of mental problems and disorders in workers during the health emergency derived from COVID-19 . In the current health emergency, it is not possible to perform a psychosocial risk assessment by applying the psychosocial risk battery in person. Therefore, the Ministry of Labor has decided to suspend the in-person realization of this evaluation until the end of the Health Emergency declared by the Ministry of Health and Social Protection. Consequently, in order to identify, evaluate, monitor and intervene the psychosocial risk factors of workers, the Battery of Instruments for the Evaluation of Psychosocial Risk Factors must be carried out virtually once the Ministry of Labor has published in the website of the Labor Risk Fund the software for its application.

Below we indicate the most relevant aspects of this Circular:

1. The Ministry recalls that through Resolution 2404 of 2019 the “Battery of Instruments for the Evaluation of Psychosocial Risk Factors” was adopted as a mandatory technical reference for the identification, evaluation , permanent monitoring and intervention of this type of risks. 2. In turn, the aforementioned Resolution establishes the periodicity with which the evaluation of psychosocial risk factors must be carried out, stating that it must be carried out periodically according to the level of risk of companies, as follows:

  • In companies in which a level of harmful psychosocial factors evaluated as high risk or that are causing negative effects on health, well-being or at work has been identified, they must carry out the evaluation on an annual basis.
  • Companies in which a medium or low risk level has been identified must carry out preventive and corrective actions and carry out the evaluation at least every two (2) years.

3. However, the Ministry indicates that given the impossibility of applying the periodicity of the Psychosocial Risk Battery as a consequence of COVID-19, it is justified to suspend the terms for its application, in accordance to what is established in article 6 of Decree 491 of 2020. In this sense, the term will begin to run when the Health Emergency declared by the Ministry of Health and Social Protection ends. 4. Notwithstanding the foregoing, the Ministry indicates that once the software for the application of the Psychosocial Risk Battery is published on the website of the Occupational Risk Fund, it may be applied in a In accordance with the provisions of article 4 of Resolution 2404 of 2019. 5. Regardless of whether the face-to-face application of the Psychosocial Risk Battery is suspended, employers, contractors, Workers and ARL must comply with the following minimum actions for the intervention of psychosocial factors, promotion of mental health and the prevention of mental problems and disorders as a consequence of COVID-19.
